Vehicle Import Service Terms

These Import Terms describe how Simply Floatin's vehicle import coordination service works, what Simply Floatin does and does not do, and the responsibilities of the customer throughout the import process.

Simply Floatin acts as an import coordinator and facilitator. Simply Floatin helps identify vehicles, communicates with overseas sellers and exporters, coordinates shipping and customs clearance, and keeps the customer informed throughout the process.

Simply Floatin does not manufacture vehicles and, unless a specific vehicle is expressly listed as owned by Simply Floatin, does not itself own the vehicle being imported before purchase is completed on the customer's behalf.

Unless otherwise stated in writing for a specific transaction, Simply Floatin is not acting as a licensed motor vehicle dealer under state law when providing import coordination services.

Vehicle purchase, title transfer, and registration obligations imposed on licensed dealers under state law may not apply to Simply Floatin's coordination role, and the customer is responsible for satisfying applicable state titling and registration requirements.

Simply Floatin is not an insurance company and does not itself insure the vehicle, cargo, or shipment.

Any marine insurance, cargo insurance, or other coverage arranged during the import process is provided by an independent third-party insurer, subject to that insurer's own terms, exclusions, and claims process.

Import services are available only to individuals who are at least 18 years old and legally capable of entering into a binding contract.

Simply Floatin may decline to provide import services to any prospective customer for any lawful reason, including where required by sanctions, export control, or other applicable law.

Before Simply Floatin begins substantive import work on a specific vehicle, the customer will generally be asked to review and sign a Vehicle Import Service Agreement or similar authorization covering that transaction.

That agreement will describe the specific vehicle, estimated costs, payment schedule, and other transaction-specific terms, and controls over these Import Terms where the two conflict.

Simply Floatin sources vehicles from overseas auctions, dealers, exporters, and other sellers based on the customer's stated preferences, such as make, model, year, mileage, and budget.

Simply Floatin does not guarantee that a specific vehicle matching every customer preference will be available.

Vehicle information, photos, auction sheets, and condition reports are obtained from overseas auctions, sellers, or exporters and are provided to the customer as received.

Simply Floatin does not independently verify every representation made by an overseas seller or auction house and is not responsible for inaccurate information originating from that third party, absent Simply Floatin's own knowing misrepresentation.

Many overseas auctions use standardized condition and grading reports prepared by independent inspectors.

These reports reflect the issuing inspector's assessment at a point in time and may not capture every mechanical, cosmetic, or historical issue affecting a vehicle.

Grading Is Not a Guarantee

An auction grade or score reflects a general condition category used within that auction system and is not a warranty of the vehicle's mechanical condition, safety, or fitness for a particular purpose.

Grading Terminology Varies

Different auction houses and inspection services may use different grading scales and terminology. Simply Floatin will explain general grading concepts on request but does not control how a given auction or inspector assigns a grade.

Before Simply Floatin proceeds with a vehicle purchase, the customer will be shown available information about the vehicle and asked to approve moving forward.

The customer is responsible for reviewing the available photos, condition reports, pricing, and estimated total cost before approving a vehicle.

Approval of a vehicle authorizes Simply Floatin to proceed with purchase on the customer's behalf and may trigger nonrefundable costs as described in the Cancellation & Refund Policy.

Because vehicles are typically located overseas at the time of purchase, Simply Floatin does not guarantee that a physical, in-person, pre-purchase inspection by Simply Floatin personnel will be performed before purchase.

The customer's approval decision will generally be based on auction sheets, condition reports, photos, and other information available at the time.

Where available and requested, Simply Floatin can help arrange a third-party independent inspection before purchase for an additional fee.

An independent inspection reflects that inspector's assessment and findings and is not guaranteed by Simply Floatin to identify every defect.

Simply Floatin will not commit to purchasing a specific vehicle on the customer's behalf until the customer has given clear approval in the manner specified in the applicable Vehicle Import Service Agreement, such as in writing or through a designated online confirmation.

Once a vehicle purchase is completed at auction or with an overseas seller, the purchase is generally final and cannot be undone by Simply Floatin.

Refund availability after purchase is governed by the Cancellation & Refund Policy.

Vehicle purchase prices are frequently denominated in a foreign currency and converted to U.S. dollars for invoicing purposes.

Currency exchange rates fluctuate and the converted amount charged to the customer may differ from an earlier estimate provided before purchase.

Simply Floatin does not guarantee a specific exchange rate unless expressly stated in writing for a given transaction.

Simply Floatin's fee for coordinating a vehicle import is separate from the vehicle purchase price and other pass-through transaction expenses.

The service fee amount and payment schedule will be disclosed to the customer before a binding import agreement is entered into, and its refundability is governed by the Cancellation & Refund Policy.

Before purchase, Simply Floatin will provide the customer with an estimate of total import costs, including the vehicle price, the service fee, and estimated shipping, customs, duty, and related expenses.

This estimate is based on information available at the time and is not a guaranteed final price.

Actual import costs can differ from the original estimate because of factors such as:

• Currency exchange rate movement
• Freight rate changes
• Customs duty assessments
• Port and terminal charges
• Additional inspection or documentation requirements
• Storage or demurrage caused by delays
• Changes in applicable law or tariffs

Simply Floatin will make reasonable efforts to notify the customer of a material cost change as soon as it becomes known.

Payment for a vehicle import is generally collected in stages tied to the progress of the transaction, such as an initial deposit, a purchase-stage payment, and a final balance covering shipping, customs, and delivery costs.

The specific payment schedule for a transaction will be set out in the applicable Vehicle Import Service Agreement or invoice.

Simply Floatin accepts payment methods disclosed at the time of invoicing, which may include bank wire transfer, ACH transfer, or another method identified by Simply Floatin.

The customer is responsible for any fees charged by their own bank or financial institution to send payment.

Unless a specific transaction expressly states that funds are held in a trust or escrow account, customer payments are treated as funds paid to Simply Floatin to be applied toward the disclosed transaction expenses and service fee, not as funds held in a segregated trust account.

Customer funds received for a transaction are applied toward the vehicle purchase price, the Simply Floatin service fee, and disclosed shipping, customs, and related transaction expenses.

Simply Floatin will maintain reasonable records of amounts collected and applied to each transaction and will account for any unused balance as described in the Cancellation & Refund Policy.

After purchase, the vehicle must be prepared for export in accordance with the laws of the country of origin, which may include deregistration, export certification, and physical preparation for shipment.

Simply Floatin coordinates this process through the exporter or its overseas partners but does not itself perform export functions that are reserved to licensed exporters under foreign law.

The customer authorizes Simply Floatin and its overseas partners to take reasonable actions necessary to comply with the export laws of the country of origin, including providing accurate buyer information required for export documentation.

U.S. importation of vehicles is subject to federal requirements, including those administered by U.S. Customs and Border Protection, the U.S. Environmental Protection Agency (EPA), and the National Highway Traffic Safety Administration (NHTSA), which may include the 25-year import exemption or another applicable exemption or approval pathway.

Simply Floatin will assess general import eligibility based on the vehicle's age and available information, but final admissibility determinations are made by U.S. Customs and Border Protection and other federal agencies, not by Simply Floatin.

The customer is responsible for confirming that a vehicle they wish to import is legally eligible for importation into the United States before approving its purchase.

Simply Floatin will not knowingly assist in importing a vehicle that is prohibited from importation under federal law, that is subject to an export or import restriction, or that is associated with a sanctioned individual, entity, or country.

Simply Floatin may decline or terminate a transaction if it determines, in its reasonable judgment, that a vehicle is not eligible for lawful importation.

Simply Floatin may provide available vehicle history information obtained from the overseas seller, auction, or third-party history reporting services.

Vehicle history reports may be incomplete, particularly for vehicles with a history outside jurisdictions that report to U.S.-based history databases.

Simply Floatin coordinates obtaining export certificates, bills of sale, and other ownership documents necessary to import and later title the vehicle in the United States.

Document names, formats, and issuing authorities vary by country of origin, and processing time for these documents is outside Simply Floatin's direct control.

Odometer readings for imported vehicles may be recorded in kilometers and are disclosed to the customer as reported by the overseas seller or auction.

The customer is responsible for complying with applicable federal and state odometer disclosure requirements when later registering or transferring the vehicle.

Vehicles are typically shipped by roll-on/roll-off (RoRo) vessel or by container, depending on the vehicle, route, and availability.

Simply Floatin will recommend a shipping method based on the vehicle and route but the final method used depends on carrier availability and scheduling.

Ocean freight is provided by independent shipping lines and freight forwarders, not by Simply Floatin.

Vessel schedules, routing, and transit times are determined by the carrier and are subject to change without notice to Simply Floatin.

Marine or cargo insurance for the ocean voyage may be available through a third-party insurer and, unless otherwise agreed, is the customer's option and expense.

A claim for loss or damage during ocean transit is submitted to and evaluated by the insurer under that insurer's own policy terms.

The vehicle will be imported through a U.S. port of entry selected based on route availability, cost, and the customer's location.

Simply Floatin will inform the customer of the anticipated port of entry but final routing decisions may be made by the ocean carrier.

After arrival, the vehicle must clear U.S. Customs and Border Protection before release.

Customs clearance timing depends on documentation completeness, any requested examination, and the current workload of the port and government agencies involved, none of which Simply Floatin controls.

Simply Floatin coordinates with a licensed customs broker to file entry documents and secure release of the vehicle.

The customs broker acts as an independent licensed professional and is responsible for the accuracy of filings made in that capacity.

Import duties, taxes, and other government-assessed fees are determined by U.S. Customs and Border Protection and other applicable agencies based on the vehicle's classification, value, and country of origin.

Simply Floatin will provide an estimate of these charges but does not control the final government assessment.

A customs bond may be required to secure the import and is arranged through a bonding company or the customs broker.

Bond fees are a pass-through transaction expense.

If a vehicle is not cleared and removed from the port within the free time allowed, storage and demurrage charges may begin to accrue.

The customer is responsible for storage or demurrage charges caused by delays in providing required documents, funds, or approvals.

After customs release, Simply Floatin can coordinate inland transportation of the vehicle to the customer's location for an additional fee, using an independent carrier.

The customer may also arrange to pick up the vehicle from the port or an agreed location.

Titling, registering, and insuring the vehicle in the customer's state is the customer's responsibility.

State requirements for titling an imported vehicle vary and may include additional inspections, VIN verification, emissions testing, or other state-specific procedures.

Simply Floatin does not guarantee that a specific vehicle will be eligible for titling or registration in every state and encourages the customer to confirm state-specific requirements before approving a purchase.

Vehicles imported under an applicable federal exemption may not be required to meet current U.S. emissions or safety standards designed for newly manufactured vehicles.

The customer is responsible for confirming any state-specific emissions, inspection, or equipment requirements that may apply once the vehicle is registered.

The vehicle is considered delivered when it is made available to the customer at the agreed port, facility, or delivery location.

The customer should inspect the vehicle at the time of delivery and promptly report any damage or discrepancy to Simply Floatin.

Any estimated timeline provided for sourcing, purchase, export, shipping, customs clearance, and delivery is an estimate only and is not a guaranteed delivery date.

Total import time commonly ranges from several weeks to several months depending on the vehicle's location, shipping route, and customs processing.

Simply Floatin is not responsible for delays caused by overseas sellers, auctions, exporters, ocean carriers, ports, customs authorities, other government agencies, weather, labor disruptions, or other circumstances outside Simply Floatin's reasonable control.

Simply Floatin will make reasonable efforts to keep the customer informed of known delays.

Simply Floatin will provide reasonable status updates as the import progresses and, where available, tracking information for the shipment.

Some information, such as vessel location or customs status, originates from third-party systems that Simply Floatin does not control and cannot guarantee to be continuously available or fully accurate.

The customer agrees to:

• Provide accurate personal, contact, and payment information
• Respond promptly to requests for approvals, documents, or funds
• Review vehicle information and condition reports before approving a purchase
• Confirm applicable state titling, registration, and compliance requirements
• Arrange timely pickup or delivery once the vehicle is available
• Pay all authorized fees and expenses associated with the transaction

A delay caused by the customer's failure to meet these responsibilities may result in additional costs for which the customer is responsible.

To the fullest extent permitted by law, Simply Floatin's total liability arising out of a vehicle import transaction is limited to the amount of the Simply Floatin service fee actually paid by the customer for that transaction.

Simply Floatin is not liable for indirect, incidental, consequential, or punitive damages, or for the acts, omissions, delays, or failures of independent third parties, including overseas sellers, auctions, exporters, carriers, customs brokers, insurers, or government agencies.

Nothing in this section limits liability that cannot be limited under applicable law.
